Even if a decision to prosecute has not been taken the police can and do in certain circumstances seek a DVPO. This an order made by the Magistrates Court often preventing a person from either attending at the family home or having contact with a member of their family- even if they didn’t want any action taking and want to resume the relationship.
Legal aid is available subject to eligibility to challenge the making of a DVPO and we may be able to prevent the order being made at all or limit its terms or duration.
